I just heard a clip from an appearance (Congress, I think) by Sebelius, in which she was asked directly if this would be a tax. After hemming and hawing, she was asked again. She replied that she’s not a lawyer, she couldn’t really say – she’d leave that up to her staff of lawyers.
She’s either too dumb to figure out what’s a tax and what isn’t, or she’s smart enough not to commit to anything.
Our only recourse now is to purge Congress of liberals and get the next one to repeal it.

The silver lining in the dark cloud of the ruling – Roberts just handed the election to Romney. Now Romney has 2 issues – the economy sucks, and the president just raised taxes on the middle class in direct contradiction to his promise.
