If you’ve been following this story, you should be familiar with Bill Elliott, the cancer patient who lost his health insurance because of ObamaCare, and was featured on Fox News, saying he would “let nature take its course.” About a week after that interview, he received an audit letter from the IRS – incredibly – on the same day C. Steven Tucker, the health insurance broker who helped him get his insurance back, received his. I’ve blogged about it, here, and at the Conversation, here, here, here and here.
Today, H/T iOWNTHEWORLD, Elliott announced on his Facebook page that his IRS audit has been abruptly TERMINATED thanks to the help of Governor Nikki Haley, Congressman Joe Wilson and an unnamed S.C. Senator.
C. Steven Tucker is still on the hook and has until December 19 to pay approximately $5,700.00 in fines.
Tucker helped Elliott get his insurance back using a HIPAA law that has been on the books for over 16 years. He’s been desperately trying to get the word out to people with pre-existing conditions that have been dropped from their health care plans. HHS’s regulations do not trump federal law.
In an interview with Arlen Williams at The American Thinker, Tucker said:
The health insurers across the nation who are canceling health insurance policies based on a posting in the Federal Register in June of 2010 which redefined the ‘grandfathered clause’ in the original PPACA (Obamacare) legislation are violating federal law. Specifically section 2742 of Public Law 104-191 (HIPAA). It is linked at my blog: TruthAboutPreexistingConditions.com.
This is an existing federal law that is still on the books and that is relied upon, expanded upon, and referred to multiple times throughout the 960 pages of the PPACA legislation. This law was codified by congress and signed by President Clinton in 1997. Since that was signed into law it has been and still is illegal for any health insurer to cancel anyone’s coverage when they are sick. Regardless of what Barack Obama or anyone else says. It has been and still is illegal for any health insurance anywhere in the nation to ‘drop your coverage’ when you get sick. Period. And, when I say period I mean it, unlike Barack Obama.
It is perhaps for this reason that Tucker is being targeted by the IRS. Perhaps this is not information the masses are supposed to know?
